In Florida, Condominium and Homeowners Associations are non-profit corporations that are comprised of unit owners who have rights to their unit as well as the common areas in their neighborhoods, along with responsibilities to follow the Association\'s rules as well as the Florida Statutes. Condominiums are governed by Florida Statute 718 and Homeowner Associations are governed by Florida Statute 720.
A wide variety of subjects are controlled by the Statutes, but the Bylaws and the Articles of the Association also dictate many rules the Association and it's owners must follow.
As a Florida Not for Profit Corporations, Associations encounter a wide variety of legal issues that arise in their daily operations, from unit owner disputes to collection of delinquent assessments and fees. Since most Associations have different rules, regulations, objectives and makeups, it is important that each Association fully explore possible sources before making a decision.
